3. User Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our services. By using our services, you represent and warrant that you meet these requirements.

4. Account Registration and Security

4.1 Account Creation

To access certain features, you may need to create an account. You agree to:

5. SMS and Voice Communication Terms

5.1 Consent to Communicate

By providing your phone number, you expressly consent to receive:

• Voice calls from our AI voice agents
• SMS text messages related to our services
• Appointment reminders and confirmations
• Service notifications and updates
• Marketing messages (if you have opted in)

5.2 Opt-Out Rights

You may opt out of SMS communications at any time by:

• Replying STOP to any text message

• Adjusting your account communication preferences

5.4 Supported Carriers

Our services are compatible with major U.S. mobile carriers. We cannot guarantee compatibility with all carriers or international numbers.

6. Acceptable Use Policy

You agree not to use our services to:

• Violate any applicable laws, regulations, or third-party rights

• Transmit harmful, fraudulent, or deceptive content

7. Call Recording and Monitoring

For quality assurance, training, and service improvement purposes, we may record and monitor voice calls made through our AI voice agents. By using our services, you consent to such recording and monitoring. You are responsible for complying with applicable call recording laws in your jurisdiction.

8. Intellectual Property Rights

8.1 Our Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, icons, software, AI models, and voice recordings, are owned by JellyFuse or our licensors and are protected by intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our services for your internal business purposes, subject to these Terms.

8.3 Your Content

You retain ownership of any content you provide to our services. By using our services, you grant us a worldwide, royalty-free license to use, store, and process your content solely to provide and improve our services.

9. Fees and Payment

12.2 AI Accuracy

While our AI voice agents are designed to be accurate and helpful, we do not guarantee perfect accuracy or that they will meet all your specific requirements. You are responsible for verifying critical information.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JELLYFUSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use our services
• Any unauthorized access to or use of your data
• Any interruption or cessation of our services
• Any bugs, viruses, or similar issues transmitted through our services
• Any errors or omissions in content

12.4 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

13. Indemnification

You agree to indemnify, defend, and hold harmless JellyFuse, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or related to:

• Your violation of these Terms
• Your violation of any rights of third parties
• Your violation of applicable laws or regulations

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us at info@jellyfuse.com. Termination does not relieve you of payment obligations for services already provided.

14.2 Termination by Us

We may suspend or terminate your access to our services at any time, with or without notice, for:

• Violation of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• Extended periods of inactivity

14.3 Effect of Termination

Upon termination, your right to use our services will immediately cease. We may delete your data in accordance with our data retention policies.

15. Dispute Resolution

These Terms are governed by the laws of the United States and the state in which JellyFuse is registered, without regard to conflict of law principles.

15.2 Arbitration

Any dispute arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

15.3 Class Action Waiver

You agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class, consolidated, or representative action.

You agree to comply with all applicable laws and regulations when using our services, including but not limited to:

• Telephone Consumer Protection Act (TCPA)
• CAN-SPAM Act
• Federal Trade Commission (FTC) regulations
• State and federal privacy laws
• Telecommunications regulations

17. Changes to Terms
